Hypervite Terms and Conditions

1. What Hypervite Does

Hypervite provides tools for creating events, inviting guests, managing RSVPs, sending reminders, sharing host updates, and coordinating event-related communications.

Hypervite is a coordination tool. Event hosts are responsible for the events they create, the guests they invite, the accuracy of event details, and compliance with applicable laws and obligations.

2. Accounts

You may need an account to use certain Hypervite features. You agree to provide accurate information and to keep your account information current.

You are responsible for activity that occurs through your account and for maintaining the security of your device and authentication methods.

3. Event Hosts

If you create or manage an event, you are responsible for:

• providing accurate event details;
• inviting only people you are authorized to contact;
• ensuring guest contact information is accurate;
• sending appropriate event-related messages;
• updating or canceling events when necessary;
• complying with applicable laws and platform rules.

You may not use Hypervite to send spam, harassment, abusive content, misleading messages, illegal content, or unrelated promotional messages.

4. Guests and RSVPs

If you receive an invitation or RSVP request through Hypervite, you may respond using available RSVP options, including SMS replies where supported.

RSVPs, guest status, and event-related responses may be visible to the event host and, depending on event settings, to other invited guests.

6. Acceptable Use

You agree not to:

• use Hypervite for unlawful, harmful, fraudulent, deceptive, or abusive purposes;
• send spam, unsolicited promotional messages, or unrelated marketing messages;
• harass, threaten, impersonate, or abuse others;
• upload or transmit malicious code;
• interfere with Hypervite’s operation or security;
• attempt to access accounts, systems, or data without authorization;
• misuse guest contact information;
• violate carrier, app store, or communications platform rules.

We may suspend or terminate access if we believe you have violated these Terms or used Hypervite in a way that creates risk for users, Hypervite, or third-party providers.

7. User Content

You may provide content through Hypervite, including event titles, descriptions, locations, updates, guest information, profile information, images, and messages.

You retain ownership of content you provide. You grant Hypervite a limited license to use, host, process, transmit, display, and store that content as needed to provide and improve the service, operate event coordination features, and comply with legal and operational obligations.

You are responsible for the content you provide and represent that you have the rights and permissions needed to provide it.

8. Privacy

By using Hypervite, you agree to our Privacy Policy.

9. Paid Features

Hypervite may offer paid features, subscriptions, or in-app purchases. Prices, billing terms, renewal rules, and cancellation options will be presented at the time of purchase.

Payments may be processed by third-party payment providers or app stores. Their terms may also apply.

10. Third-Party Services

Hypervite may rely on third-party services, including SMS providers, hosting providers, app stores, authentication providers, payment processors, storage providers, and mapping or location services.

We are not responsible for third-party services, and their terms and policies may apply.

11. Service Availability

We aim to provide a reliable service, but Hypervite may be unavailable, delayed, interrupted, or changed from time to time.

We do not guarantee that messages, invitations, reminders, updates, or cancellations will always be delivered, delivered on time, or displayed without error.

12. Disclaimers

Hypervite is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, Hypervite LLC and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, message delivery failure, or event-related losses.

To the fullest extent permitted by law, Hypervite’s total liability for any claim related to the service will not exceed the greater of the amount you paid to Hypervite in the twelve months before the claim or $100.

14. Indemnification

You agree to indemnify and hold harmless Hypervite LLC and its owners, employees, contractors, service providers, and affiliates from claims, damages, liabilities, costs, and expenses arising from your use of Hypervite, your events, your content, your guest communications, your violation of these Terms, or your violation of applicable law or third-party rights.

15. Termination

You may stop using Hypervite at any time.

We may suspend or terminate access to Hypervite if we believe you have violated these Terms, created legal or operational risk, abused the service, or used the service in a way that harms Hypervite or others.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Continued use of Hypervite after changes become effective means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles.
